Before purchasing a holiday voucher at the Wonder Home Apartments, please read these Regulations and accept their content. These Regulations are consistent with the provisions of Art. 8.1. point 1 of the Act of July 18, 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2016, item 1030, as amended).
§1. [Definitions]
- Publisher - Apartamenty Wonder Home Spółka z ograniczoną odpowiedzialnością, based in Karpacz, [code 58-540], at ul. Myśliwska 1H/2, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division, under KRS number: 0001018736, REGON: 524448551, NIP: 6112824270 and Sebastian Aksak, running a registered business under the company name Wonder Home Apartments, based in Legnica, at ul. Janowska 68, [code 59-220], sales office ul. Konstytucji 3 Maja 17 in Karpacz [code 58-540], NIP 691-173-91-67; Service Provider within the meaning of the Act of July 18, 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2016, item 1030);
- Holiday Voucher - is an electronic bearer voucher issued by the Publisher, with a value equal to the denomination indicated on the Voucher, with a unique serial number, for one-time use to pay for the apartment rental when booking directly via the website. www.wonderhome.eu, within 12 months of its purchase;
- Bearer – each holder of a unique serial number assigned to a Holiday Voucher;
- Buyer – a natural person, legal person or organizational unit with legal capacity who purchases a Holiday Voucher from the Issuer by paying the nominal value specified on the Holiday Voucher.
- Apartment rental - accommodation service offered by the Issuer on the date of redemption of the Holiday Voucher by the Bearer, presented on the website www.wonderhome.eu and carried out in accordance with the applicable Regulations for the provision of services to Wonder Home Guests;
- Distance contract - a contract concluded with a consumer at a distance, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract, which is regulated by the Act of May 30, 2014 on consumer rights (i.e. Journal of Laws .U.2017.683, as amended)
§ 2. [General terms and conditions of purchase and redemption of the Holiday Voucher]
- The Holiday Voucher can be purchased in person at any Wonder Home reception desk or by phone or e-mail, however, before making the payment, it is necessary to contact the Wonder Home reception staff to determine the nominal value of the Voucher and the method of payment. Payment for the Voucher is not possible in the reservation system.
- After paying the nominal value of the Holiday Voucher, the Buyer receives an electronic Voucher to the e-mail address provided for delivery.
- The Holiday Voucher may be issued to the bearer without providing his/her personal data or in a personalized version, using the name and surname.
- The circumstance of personalization does not affect the Voucher redemption procedure, which means that the nominal value indicated on the Voucher will be used to pay for part or all of the Bearer's reservation, after providing the unique serial number placed by the Issuer on the Voucher, and the Issuer does not verify the personal data of the person making the reservation with the person shown. on Voucher.
- The Publisher is not responsible for Holiday Vouchers which, after being sent to the e-mail address provided by the Buyer, were then redeemed by an unauthorized person who came into possession of the unique serial number without the Buyer's consent.
- The Buyer and the Bearer are not entitled to any claims against the Issuer for loss, theft or redemption of the Voucher by a third party who came into possession of the unique serial number without the Buyer's consent.
- The Holiday Voucher is not refundable or exchangeable for cash (paid by bank transfer or in cash), in whole or in part.
- The Holiday Voucher can be redeemed within a maximum period of 12 months from the date it was generated. The Voucher is deemed to be redeemed by making a reservation and using the nominal value of the Voucher to pay for the short-term rental service. The date of stay can be specified for a maximum period of 12 months from the date of payment for the reservation using the Voucher.
- After the expiry date of the Holiday Voucher, it cannot be used to settle the stay.
- In order to redeem the Voucher, the bearer selects an apartment from among all the premises available on the selected date www.wonderhome.eu
- If the total price for the Bearer's stay in the apartment paid for using the Holiday Voucher is lower than the nominal value of the Holiday Voucher, the Bearer is not entitled to a refund of unused funds in any form.
- If the total price for the Bearer's stay in the apartment chosen by him is higher than the nominal value of the Holiday Voucher, the Bearer is obliged to pay the difference in price. In such a case, the additional payment is possible using the payment methods used by the Issuer at the time of payment by the Bearer. At the same time, the lack of an additional payment makes it impossible to stay in the selected apartment.
- Complaints related to the purchase of a Voucher will be considered by the Issuer within 14 (fourteen) days from the date of submitting a written complaint, to the office or e-mail address: kontakt@wonderhome.eu
- The purchaser of the Holiday Voucher by e-mail, in accordance with the provisions on concluding a distance contract, in accordance with Art. 38 point 12 of the Act of May 30, 2014 on consumer rights (Journal of Laws of June 24, 2014) has the right to withdraw from the contract within 14 days without giving reasons. However, if within 14 days of purchasing the Voucher the nominal value indicated on it is used to settle the stay, the Buyer is not entitled to withdraw. In such a case, the right to withdraw expires upon payment for the reservation using the Voucher.
- Before purchasing a Holiday Voucher, the Buyer has the right to read these regulations, and making a payment for the Voucher is tantamount to accepting the provisions contained therein.
- The bearer staying in the Wonder Home Apartments is obliged to comply with the Regulations for Wonder Home Guests, available at: www.wonderhome.eu
§ 3. [Final provisions]
- The content of the Regulations is published on the Wonder Home Apartments Website.
- In matters not regulated in the Regulations, the Regulations for the provision of services to Wonder Home Guests and the provisions of:
- Act on the provision of electronic services - of July 18, 2002 (Journal of Laws of 2016, item 1030, as amended);
- Personal Data Protection Act - of August 29, 1997 (consolidated text: Journal of Laws of 2016, item 922, as amended);
- Civil Code Acts - of April 23, 1964 (Journal of Laws of 2016, item 380, as amended);
- Act on Tourist Services - of August 29, 1997 (consolidated text: Journal of Laws of 2011, item 432, as amended);
- Act on Consumer Rights - of May 30, 2014 (Journal of Laws of 2014, item 827, as amended);
